This game titled “The Etherscape” offers a premium in-game currency called “Gems” (further referred to as the “Currency”) that can be obtained by swapping for the crypto token “Enjin” or obtained through gameplay. The Currency can be used to access or unlock certain features or items within the game. The Currency is for in-game use only and has no real-world value. You cannot sell, exchange, transfer, or cash out any Currency you have obtained, except for swapping it back to Enjin under certain conditions.

By obtaining the Currency, you agree to the following terms and conditions:

• You acknowledge that the Currency represents a limited, non-transferable, non-exclusive license to use the features or items of the game for personal use and does not represent a property interest of any kind.

• You acknowledge that the Currency is subject to a dynamic exchange rate that fluctuates based on the market activity of the users, creating a sense of scarcity and opportunity for the users. The exchange rate is determined by the game developer and may change at any time without notice. The exchange rate may affect the amount of Currency you can obtain with crypto token swaps or the amount of features or items you can access or unlock with the Currency.

• You acknowledge that the game developer reserves the right to modify, suspend, or terminate the Currency system at any time for any reason, with or without notice, and without any liability to you or any third party. The game developer also reserves the right to revoke or cancel any Currency you have obtained if you violate the game terms of service, privacy policy, or any applicable laws or regulations.

• You acknowledge that you are responsible for reporting and paying any taxes that may apply to the Currency transactions, in accordance with the laws and regulations of your jurisdiction. You also acknowledge that you are responsible for complying with any laws and regulations that may apply to the Currency transactions, such as the anti-money laundering, consumer protection, privacy, security, and fraud laws and regulations.

• You acknowledge that you have the option to swap any Currency you have obtained back to Enjin, subject to the terms and conditions of the game developer and the crypto token provider. You acknowledge that the game developer does not guarantee that this option will always be available or what price the swap will be at. You acknowledge that the crypto token provider is a separate and independent entity that is not affiliated with, endorsed by, or controlled by the game developer, and that the game developer is not responsible or liable for any issues or risks associated with the crypto token transactions, such as the volatility, security, legality, or availability of the crypto token.

• You acknowledge that you have read and understood this disclosure and that you agree to be bound by its terms and conditions. If you do not agree to these terms and conditions, you should not obtain any Currency.
